1. General Compliance Requirement
All Buyers of firearms and ammunition from Bear Creek Ballistics are required to comply with all federal, state, and local laws regulating the purchase, possession, transfer, and use of firearms and ammunition. The Buyer is solely responsible for understanding and adhering to the specific laws in their jurisdiction.
2. Certification of Legal Compliance
By placing an order with Bear Creek Ballistics, the Buyer certifies that they:
- Are legally permitted to purchase and possess the firearm(s) or ammunition being ordered in accordance with federal, state, and local law.
- Are not prohibited from possessing firearms or ammunition due to prior criminal convictions, restraining orders, mental health conditions, or any other legal disqualification.
- Understand and will adhere to any applicable waiting periods, background check requirements, and other purchase or transfer restrictions.
3. Firearm and Ammunition Restrictions by State and Local Jurisdictions
Certain states and localities impose additional restrictions or requirements on the purchase and transfer of firearms and ammunition. The Buyer agrees to comply with the following state-specific restrictions:
California:
- Firearms: California imposes restrictions on certain types of firearms, including assault weapons, high-capacity magazines, and certain features such as threaded barrels. Firearms sold to California Buyers must be on the state’s approved roster or comply with California law.
- Ammunition: All ammunition sales must be conducted through an FFL or approved vendor. Online ammunition purchases must be shipped to an FFL, and background checks are required for ammunition purchases.
New York:
- Firearms: Assault weapons and certain high-capacity magazines are prohibited. New York also imposes additional restrictions on features such as folding or telescoping stocks and threaded barrels.
- Ammunition: No ammunition sales are permitted to New York City (including all boroughs) or Manhattan. Buyers outside of New York City must comply with state regulations on ammunition purchases and provide required FFL documentation.
Illinois:
- Firearms: Certain firearms, including assault weapons and high-capacity magazines, are restricted in Cook County and other municipalities.
- Ammunition: Buyers must provide a valid Firearm Owner’s Identification (FOID) card and a copy of their State ID to purchase ammunition. No ammunition sales are permitted in Chicago or Cook County without an FFL.
Massachusetts:
- Firearms: Only firearms on the state’s approved roster may be sold. Certain types of firearms, including assault weapons and high-capacity magazines, are prohibited.
- Ammunition: No ammunition sales are permitted without an FFL. All ammunition transactions must comply with Massachusetts law.
New Jersey:
- Firearms: New Jersey imposes restrictions on certain firearms, including assault weapons, high-capacity magazines, and certain features such as folding stocks and flash suppressors. Firearms sold to New Jersey Buyers must comply with state law.
- Ammunition: New Jersey Buyers must comply with state requirements for purchasing ammunition, including background checks and limits on the types of ammunition permitted for sale.
Washington, D.C.:
- Firearms: Only firearms that comply with local laws may be sold. Certain firearms, including assault weapons and high-capacity magazines, are prohibited.
- Ammunition: No ammunition sales are permitted without an FFL.
Connecticut:
- Firearms: Assault weapons and high-capacity magazines are prohibited. All firearms sold in Connecticut must comply with state law, including magazine capacity limits.
- Ammunition: Buyers must provide proof of eligibility to purchase ammunition, including a valid permit, eligibility certificate, or state-issued ID.
Colorado:
- Firearms: High-capacity magazines (more than 15 rounds) are restricted.
- Ammunition: Ammunition sales must comply with all applicable Colorado state and local laws.
Hawaii:
- Firearms: Assault weapons and certain high-capacity magazines are prohibited.
- Ammunition: Ammunition sales must comply with all applicable Hawaii state laws.
Maryland:
- Firearms: Assault weapons and certain high-capacity magazines are prohibited. All firearms sold to Maryland Buyers must comply with state law.
- Ammunition: Ammunition sales must comply with all applicable Maryland state laws.
Washington State:
- Firearms: Washington imposes restrictions on certain types of firearms and firearm features. Buyers must comply with all applicable state and local laws.
- Ammunition: Ammunition sales must comply with all applicable Washington state laws.
4. Documentation and Licensing Requirements
Certain states and localities require the Buyer to provide specific documentation or licenses before completing the purchase of firearms or ammunition. This may include:
- Firearm Owner’s Identification (FOID) Card: Required in Illinois for firearm and ammunition purchases.
- Permit to Purchase/Eligibility Certificate: Required in states such as Connecticut and New Jersey for ammunition purchases.
- Federal Firearms License (FFL): Required in certain jurisdictions for ammunition sales.
The Buyer must provide Bear Creek Ballistics with all required documentation prior to shipment. Failure to provide proper documentation may result in cancellation of the order.
5. Shipping Restrictions
Bear Creek Ballistics will not ship firearms or ammunition to states, cities, or jurisdictions where they are prohibited by law. These restrictions include, but are not limited to:
- New York City, NY: No firearms or ammunition shipments allowed.
- Cook County, IL: No ammunition shipments without an FFL.
- Washington, D.C.: No firearms or ammunition shipments without an FFL.
- California: Firearms and ammunition shipments must comply with state laws, including ammunition shipments to an FFL.
- International Shipments: No firearms or ammunition will be shipped outside the United States.
6. Firearm and Ammunition Purchase Conditions
The Buyer agrees to abide by all legal requirements for purchasing firearms and ammunition in their jurisdiction, including:
- Background Checks: Buyers must comply with all background check requirements imposed by federal, state, and local laws prior to receiving firearms.
- Waiting Periods: Certain states impose mandatory waiting periods before the transfer of firearms. The Buyer must comply with all waiting period requirements.
- Magazine Capacity Limits: Some states have restrictions on the capacity of firearm magazines. The Buyer agrees to comply with all applicable magazine capacity limits in their jurisdiction.
7. Indemnification
The Buyer agrees to indemnify, defend, and hold harmless Bear Creek Ballistics and its affiliates, officers, employees, and agents from any and all claims, liabilities, damages, or expenses arising from the Buyer’s failure to comply with federal, state, or local laws regarding the purchase, possession, or use of firearms or ammunition.
8. Acknowledgment of Responsibility
By purchasing firearms or ammunition from Bear Creek Ballistics, the Buyer acknowledges that they have reviewed and understood the state-specific restrictions and requirements outlined in this document. The Buyer further agrees that they are legally permitted to purchase and possess the items ordered and that they assume all responsibility for ensuring compliance with all applicable laws.
This Compliance with State-Specific Laws and Guidelines constitutes the entire agreement between Bear Creek Ballistics and the Buyer regarding the purchase of firearms and ammunition. The Buyer acknowledges having read and agreed to these terms before completing any purchase.
